H-1B Cap Gap Information
The cap-gap extension is a period in which an eligible F-1 student's status is automatically extended to bridge the gap between the end of F-1 status and the start of H1-B status.
F-1 duration of status (D/S) and any post-completion OPT or STEM OPT work authorization is automatically extended for an F-1 student who is the beneficiary of a timely-filed H1-B petition requesting change of status and an employment start date of October 1st (the first calendar day of the following federal fiscal year).
If the H-1B petition and change of status application is not approved by October 1st, the cap-gap extensions of employment authorization and duration of status end. The student must stop working (with September 30 being the final day of employment) until the H-1B petition is approved.
An automatic cap-gap extension of an F-1 student's duration of status also applies to the duration of status of the student's dependents in F-2 status, but does not grant work authorization to the F-2 dependents.
